1. Who you are buying from
24Design is a trading name of [REGISTERED COMPANY NAME], company number [COMPANY NUMBER], registered at [REGISTERED ADDRESS]. You can reach us at hello@gazar.dev. In these terms “we” and “us” mean that company, and “you” means the person or business placing the order.
2. What we sell
We sell jewellery design files, delivered as a download. We do not sell finished jewellery. We do not cast, set, size, polish, engrave, ship, insure or handle returns of physical goods, and nothing in an order creates an obligation on us to do any of those things.
Making the piece is a separate arrangement between you and a jeweller of your choosing. We are not party to it, we do not receive any part of what they charge, and we are not responsible for their work.
3. What you receive
If you buy without a jeweller’s account, you receive a specification sheet naming the design, the size, the metal, the finish and the measured weight, for you to give to a jeweller. If you hold a jeweller’s account on the platform, you receive the production geometry. Which of the two applies to you is stated before you pay.
4. Licence
On payment we grant you a non-exclusive, non-transferable licence to use the design to make the piece it describes, including having it made for you by a jeweller.
You may not:
- redistribute, resell, sublicense, publish or share the file itself;
- make the file available to anybody except a jeweller making the piece for you;
- use the design to produce a competing design file for sale, or to train a model that generates design files.
The right sold is the right to make. It is never the right to pass on. We keep all intellectual property in the design; nothing here transfers ownership of it.
5. Who owns a purchase
A design bought by a member of a practice belongs to the practice, not to the individual who placed the order, and a colleague added to that practice afterwards has the same access to it. A design bought by somebody with no practice belongs to them personally.
6. Price, currency and tax
Prices are shown in US dollars and exclude tax. Tax is calculated at checkout for the address you give and shown to you before you pay. If your payment card is denominated in another currency, your bank sets the conversion rate and may add its own charge; we do not control either.
Payment is taken by Stripe. Your card details are handled by Stripe and are never received or stored by us.
7. Delivery
Delivery is immediate: the design becomes available in your account as soon as payment completes. There is nothing to ship and no delivery charge.
8. Cancellation and refunds
You may cancel and receive a full refund at any time before you download the design. Your orders page shows the eligibility of each item and lets you take the refund yourself.
Because this is digital content supplied immediately, downloading it ends the right to cancel. You are asked to acknowledge that at checkout before paying, and the acknowledgement is recorded with the order. Where an order carried tax, a refund reverses the tax with it. Refunding one design from an order does not affect the others.
None of this affects your rights if a design is faulty, not as described, or not fit for purpose.
9. Availability
We may withdraw a design from sale at any time. Withdrawal does not affect anybody who has already bought it: what you own remains yours and remains available to download.
We may also stop offering a particular size where it falls below the wall thickness that can be cast reliably. Sizes offered therefore differ between designs.
10. What we are and are not responsible for
We are responsible for the design file being what we describe: the geometry, the measurements and the size stated. Every size we sell has passed a manufacturability check, and where a check was not applied to a particular design we record that.
We are not responsible for the work of the jeweller who makes the piece, for the cost of that work, for the metal price on the day, or for a piece being made differently from the specification we supplied. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else which cannot lawfully be excluded.
Subject to that, our total liability arising from an order is limited to the amount you paid for it.
11. Changes
We may change these terms. The terms that apply to your order are the ones published when you placed it, and the date at the top of this page tells you which those are.
12. Law
These terms are governed by the law of England and Wales, and its courts have non-exclusive jurisdiction. If you are a consumer, this does not remove the protection of the law where you live.
13. Complaints
Write to hello@gazar.dev. We reply within two working days and will tell you what we can do.
